These Terms & Conditions apply when you use the Future Foods Fundraising website, create an account, organise a fundraiser, purchase fundraising products, or otherwise use services provided by Future Foods Auckland 2021 (“Future Foods”, “we”, “us” or “our”). By using the website, you agree to these terms.

Using the website

You must use the website lawfully and provide accurate information. You are responsible for keeping your login details secure and for activity carried out through your account. You must not misuse the website, attempt unauthorised access, interfere with its operation, or use it in a way that could harm Future Foods, organisers, supporters, or other users.

Accounts

You may need an account to organise a fundraiser or complete certain purchases. You are responsible for ensuring that your account information remains current and accurate. We may suspend or restrict an account where reasonably necessary for security, misuse, fraud prevention, or compliance purposes.

Fundraiser applications and approval

Fundraiser applications are subject to approval by Future Foods. We may ask for additional information, decline an application, pause a fundraiser, or require changes where reasonably necessary. Start and end dates, product availability, delivery or collection arrangements, and other fundraiser details may be subject to operational requirements.

Products and availability

Product descriptions, images, prices, fundraising returns, flavours, packaging and availability may change from time to time. We take reasonable care to keep information accurate, but minor differences in appearance or packaging may occur. If a product becomes unavailable, we may contact the organiser or customer to arrange a suitable alternative, refund, or other reasonable solution.

Pricing and fundraiser returns

The website shows the customer purchase price and the amount or percentage that goes to the relevant fundraiser. The fundraiser return displayed at the time of purchase is the amount used for that order, subject to any correction required for an obvious pricing or system error.

Orders and payment

Orders are not confirmed until payment has been successfully completed. Payments are processed through our payment provider. We may cancel or refund an order where payment fails, an item is unavailable, there is an obvious pricing error, or we cannot reasonably fulfil the order.

Collection and delivery

Collection and delivery options depend on the fundraiser. Customers and organisers are responsible for following the collection or delivery instructions shown for that fundraiser. Where frozen products are included, suitable frozen storage and handling must be maintained until products are distributed to supporters.

Refunds and cancellations

Because fundraising orders are often prepared specifically for a fundraiser, cancellations or changes may not always be possible after the fundraiser closes or after preparation has begun. If an order is incorrect, damaged, missing, or cannot be supplied, please contact us as soon as possible so we can assess the issue and provide an appropriate remedy.

Organiser responsibilities

Organisers are responsible for providing accurate fundraiser information, choosing appropriate products and fulfilment options, communicating relevant collection or distribution information to supporters, and using supporter information only for purposes connected with the fundraiser and order fulfilment.

Website availability

We aim to keep the website available and operating reliably, but we do not guarantee uninterrupted access. We may carry out maintenance, updates or security changes and may temporarily restrict access where reasonably necessary.

Intellectual property

The Future Foods name, branding, website content, layout, graphics and other materials are owned by or licensed to Future Foods unless stated otherwise. You may not copy, reproduce or use them commercially without permission.

Liability

Nothing in these terms limits rights that cannot legally be excluded, including rights under applicable New Zealand consumer law. To the extent permitted by law, Future Foods is not responsible for indirect or consequential loss arising from use of the website or fundraising service.

Changes to these terms

We may update these Terms & Conditions from time to time. The latest version will be published on this page with the updated date.
